Terms & Conditions
By registering for an admission ticket(s) or pass(es) to the Event (as defined below), and/or by attending, accessing, entering, viewing, and/or participating in (collectively, “Attend” or “Attending”, for the avoidance of doubt, the foregoing definition includes registering for, attending, accessing, entering, viewing, and/or participating in the Event) PISTONSLAND: WHAT UP D.O.E. 2024 ( the “Event”) or any part of the Event you understand, acknowledge, and agree on behalf of yourself and on behalf of any individual who uses a ticket, pass, or reservation secured or made by you or who accompanies you to the Event, including, without limitation, any Minors (each shall be referred to as “you” or “your”) that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you should not register, attend, access, enter, participate in, and/or view the Event. In the event you are a Minor (as defined herein), all uses of the term “you” in these Terms and Conditions shall also be deemed to include such Minor’s parent or legal guardian.
At any time, any of the Released Parties (as defined below) may amend these Terms and Conditions without notice to you by posting the amended Terms and Conditions on the Event website. By continuing to Attend the Event, such shall constitute your acceptance of any such amended Terms and Conditions.
As used in these Terms and Conditions, “Producer” shall mean Redrock Entertainment Services, LLC and, to the extent applicable, any partner organizations which work with Redrock Entertainment Services, LLC to produce or manage the Event.
ASSUMPTION OF RISK AND RELEASE
You acknowledge that there are dangers, hazards, and risks incidental to the Event and your Attending of the Event. By Attending the Event, you freely and voluntarily assume any and all risks and dangers incidental to the Event, regardless of severity and regardless of whether or not caused by the negligence of the Released Parties, including, but not limited to, loss, property damage, injury or damage to persons and/or death. Further, you acknowledge that there is an inherent risk of exposure to communicable diseases, including, but not limited to, COVID-19, in any public place where people are present, and, by Attending the Event you freely and voluntarily assume any and all risks, hazards, and dangers arising from or relating in any way to such exposure – whether that exposure occurs before, during, or after the Event and regardless of how caused or contracted. You agree to follow all health and safety instructions, guidelines, or standards issued by local, state, and federal governmental authorities, as well as any health and safety instructions, guidelines, or standards for the Event which may be posted on-site at the Event, on the Event website and/or other digital and/or social platform(s), or as otherwise provided to you by the Event.
In consideration for Attending the Event, to the greatest extent permitted by applicable law, you hereby release and forever discharge Redrock Entertainment Services, LLC, Live Nation Worldwide, Inc., Rock The Vote., Propper Daley, LLC, the City of Detroit, Pistons Performance, LLC, Detroit Pistons Basketball Company, LLC, Palace Sports and Entertainment, LLC, and their respective parents, affiliated entities, officers, directors, owners, employees, agents, and representatives (collectively, the “Released Parties”) from any and all claims, actions, damages, liabilities, costs or expenses (including attorney fees) which are related to, arise from or out of, or are in any way connected to the Event and/or your Attending the Event, whether or not such claims, actions, damages, liabilities, costs or expenses are caused by the negligence of the Released Parties or by the infringement or violation of any right. This release shall be effective and binding upon you and any of your heirs, agents, personal representatives or assigns (and of the parent or legal guardian of any Minor’s). A “Minor” shall mean any individual who is under eighteen (18) years of age or has not reached the age of majority as defined by such individual’s jurisdiction of residence.
THE WAIVER AND RELEASE GRANTED BY YOU HEREUNDER IS LEGALLY BINDING AND SHALL BE CONSIDERED IRREVOCABLE. YOU AGREE THAT THE RELEASED PARTIES MAY RELY UPON THIS AGREEMENT TO THE FULLEST EXTENT PERMISSIBLE AT LAW OR IN EQUITY.
INDEMNITY
You agree to indemnify and hold harmless the Released Parties from and against any and all losses, costs, claims, damages, or injury or liability of any kind or nature whatsoever (including but not limited to reasonable attorneys’ fees and costs) (collectively, “Claims”), whether to persons or to property, caused by you to the extent arising from, or related to: (i) your Attending the Event and (ii) any claim or action of any kind including, but not limited to, any claim or action for personal injury (including death), illness, and/or property damage in respect of any act or omission of and/or by you.
RECORDING, TRANSMISSION AND EXHIBITION
You acknowledge and agree that the Event is a public event, that your appearance and actions inside and outside the site where the Event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the Event. You grant permission to the Released Parties, including but not limited to their respective brand and media partners, to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the Event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.
INCIDENTALS
You acknowledge that you are solely responsible for any costs incurred in connection with any incidentals or expenses required in order for you to Attend the Event, including, but not limited to, travel, accommodations, Internet connection, mobile access, and/or the use of any personal devices. Except as may be required by applicable law, Producer will not be responsible or liable for any costs associated with Attending the Event and all such costs shall be borne solely by you.
ACCESS TO THE EVENT
Except as may be required by applicable law, you are solely responsible for ensuring that you are able to Attend the Event, including, but not limited to, any requirements that the Event, Producer, and/or the Released Parties specifies or makes available on the Event website, on-site at the Event, or on any other Event related digital or social media platforms. The Released Parties are not responsible for any technical difficulties arising as a result of your use of your own technology in connection with the Event.
PERSONAL PROPERTY
Upon entry to any portions of the Event, all attendees, their bags and other personal property may be subject to screening or security checks. Producer expressly reserves the right to prohibit any personal property from entry into the Event.
All personal property brought to the Event is done so at your own risk and you are responsible for safeguarding such property at all times. You hereby acknowledge and agree that the Event and Producer are not responsible for, and shall have no liability resulting from, any loss or damage to any personal property belonging to you, including, but not limited to, loss or damage resulting from fire, storms, acts of God, air conditioning or heating failure, theft, pilferage, bomb threats, roof leaks, other attendees participating in the Event or other causes, to the extent consistent with applicable law.
No personal property may be left unattended while in or around the Event. Producer will handle unattended property however it deems appropriate in its sole and absolute discretion. Any personal property which is left at or within the Event grounds upon the conclusion of the Event shall be considered abandoned and handled by the Producer accordingly.
USE OF TICKETS AND/OR PASSES
All tickets and/or passes are a revocable license to Attend the Event and Producer reserves the right to revoke such license at any time in its sole reasonable discretion.
LOSS OF TICKETS AND/OR PASSES
Any tickets and/or passes which are made available to you must be protected and safeguarded at all times. You hereby acknowledge and agree that the Producer is not responsible for, and shall have no liability resulting from, any loss or damage to any tickets and/or passes.
RESALE OF TICKETS AND/OR PASSES
Each ticket and/or pass is non-transferable and cannot be reproduced or resold. Ticket(s) and/or pass(es) are immediately rendered void if altered in any way. The unauthorized resale of ticket(s) and or pass(es) (including, but not limited to, “scalping”), the attempted unauthorized resale of ticket(s) and or pass(es), the unauthorized assignment of ticket(s) and or pass(es), the creation of counterfeit ticket(s) and or pass(es), or the unauthorized transfer of any ticket(s) and or pass(es) to a third party are strictly prohibited and constitute an immediate forfeiture of your ticket(s) and or pass(es) without compensation from the Producer.
REMOVAL FROM THE EVENT
Producer reserves the right, without refund of any amount paid, to refuse admission to, or eject, any person(s) whose conduct it deems disorderly, disruptive, illegal, offensive, unsafe, and/or threatening, and/or who uses vulgar or abusive language, and/or who fails to comply with Producer and/or Event rules. Any such determination by Producer shall be final. Breach of these Terms and Conditions and/or Event rules will terminate your license to attend the Event without refund. A ticket and/or pass is a revocable license and admission may be refused. A ticket is not redeemable for cash.
PROPER ATTIRE
At all times in connection with the Event, you will wear proper attire, including shoes and shirts. Producer reserves the right to deny access or remove you from the Event for wearing inappropriate attire or attire that could detract from the Event overall, in Producer’s sole and absolute discretion.
EVENT FEATURES
The Event’s hours of operation, schedules, performers, exhibitors, vendors, entertainment, speakers, and other products, services, and items are subject to change, closure, cancellation, varying levels of availability, and discontinuance without notice to you for any reason and without liability to the Released Parties. Attending the Event is not guaranteed.
CANCELLATION POLICY
Producer reserves the right to cancel or postpone the Event, or any part of the Event, on limited or no notice in Producer’s sole discretion. In the event of a cancellation or postponement of the Event, Producer shall not be responsible or liable for any costs, damages, fees, expenses or other compensation associated with the Event.

Producer will not be liable for travel or any other expenses that you or anyone else incur in connection with a canceled, postponed, rescheduled, or moved event.
EVENT POLICIES
At all times in connection with the Event, you are required to comply with and behave in accordance with (i) these Terms and Conditions; (ii) all applicable laws, ordinances, codes, regulations, standards and judicial or administrative orders; and (iii) any additional Event rules, regulations, policies, or procedures which may be posted on-site at the Event, on the Event website and/or other digital and/or social media platforms, or otherwise distributed to You by Producer and as may be updated from time to time by Producer (collectively, the “Event Policies”). By Attending the Event, you acknowledge and agree that you have read, agree to comply with, and will behave in accordance with the Event Policies.
The Event Policies apply to EVERYONE Attending the Event in any manner whatsoever. You, and each person Attending the Event, are solely responsible for their own conduct while Attending the Event or any part of the Event. Parent(s) or legal guardians are solely responsible for the conduct of any Minors Attending the Event or any part of the Event.
As part of the Event Policies, each person Attending the Event agrees that they will not, and will not directly or indirectly cause others to, do any of the following “Prohibited Activities” in connection with the Event:
interfere with, damage, or engage in any act which disrupts the operation of the Event in any way, including but not limited to, obstructing entrances or exits, running, cutting in line, saving places in lines for others, jumping over barriers or guardrails, rushing the stage or other areas, using foul language, screaming, yelling, encouraging disruptive behavior from others, disobeying any time limits, directions or prohibitions provided to you by Producer’s staff and/or security team, or preventing any other person from Attending the Event by any means;
distribute, wear, transmit, upload, display or otherwise circulate any content which is inaccurate, unlawful, infringing, defamatory, obscene, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, or otherwise objectionable to Producer in Producer’s sole discretion;
distribute printed or recorded materials of any kind unless prior written approval has been obtained from Producer;
impersonate any other person or entity or perform any similar fraudulent activities;
sell goods or services, display goods or services, make solicitations of any kind, or conduct any commercial activities without the prior written approval of Producer;
harvest, collect, or attempt to collect the personal information, email addresses or other contact information of other person(s) Attending the Event without the consent of such person(s);
defame, harass, abuse, threaten or defraud other person(s) Attending the Event.
please be advised that Producer has a ZERO TOLERANCE POLICY for harassment of any kind.
circumvent, disable, damage, remove or otherwise interfere with the security, integrity, or proper conduct of the Event;
access any unauthorized part of the Event designated as only for Producer and/or Event use;
access the Event website, digital, and/or social media platforms by means of any robot, spider, scraper, crawler or other automated means for any purpose;
Attend the Event for any illegal purpose, or in violation of any applicable local, state, national, or international law or regulation, including, without limitation, laws governing intellectual property and other proprietary rights, data protection and privacy;
smoke within the Event site, which includes, but is not limited to, cigarettes, vape pens, and marijuana;
drink or possess alcohol within the Event site outside of the specifically designated areas. No one under the age of 21 may consume alcohol within or around the Event;
use, sell, possess, or distribute any illegal drugs or other illegal substances, including, but not limited to, any medication that has not been legally obtained, is not being used in its intended dosage or for its intended purpose;
assault, steal, fight, engage in or incite violence of any kind, including, but not limited to, verbal threats of violence; and
possess and/or use any of the following prohibited items in connection with the Event:
a firearm, ammunition, knife, or weapon of any kind;

objects or toys that appear to be firearms, ammunition, knives, or weapons;
NOTE: Event security and local law enforcement officials will treat anything that looks like a real gun as a real gun.
self-defense or restraining devices;
fireworks or other explosive or flammable objects;
glass containers;
recreational devices such as drones, remote control toys, skateboards, scooters, inline skates or shoes with built-in wheels;
strollers which are greater than 31” in width and 52” in length;
folding chairs;
selfie sticks;
balloons;
flags and/or other large objects that obstruct views.
OWNERSHIP
Unless otherwise indicated, any materials provided to you in connection with the Event including, but not limited to, any images, videos, logos, advertisements, promotional copy, information, data, content, educational materials, trademarks, service marks, and other materials displayed or distributed in connection with the Event (collectively, the “Materials”) are the property of Producer, its partners, affiliated companies, and/or licensors.
You are granted a limited, conditional, non-exclusive, non-transferable, non-sublicensable license (i.e. a personal and limited right) to Attend the Event and utilize the Materials solely for your personal use. Producer may terminate this license at any time without notice. You agree that nothing herein shall be deemed a grant of any intellectual property rights or other rights to use the Materials except as expressly provided by Producer in writing. Any use of the Event or the Materials, except as specifically authorized in these Terms and Conditions without the prior written permission of Producer, is strictly prohibited.
You agree that you have no expectation of privacy or confidentiality with respect to the Event (including, without limitation, any “private” interactions with other Event attendees and/or guests) and that Attending the Event shall at all times be subject to these Terms and Conditions and may be monitored by Producer without notice.
PRIVACY
By Attending the Event or by submitting information to Producer in connection with the Event, you agree to the terms of Producer’s Privacy Policy which may be updated by Producer at any time. Continuing to Attend the Event shall constitute your acceptance of any such updated Privacy Policy. All person(s) Attending the Event are expected to review the Privacy Policy carefully before Attending the Event and you acknowledge that, in the event of a conflict or inconsistency between these Terms and Conditions and the Privacy Policy, the terms of the Privacy Policy shall prevail, govern and control.
Additionally, by Attending the Event or by submitting information (including, without limitation, by registering for the Event), you accept Rock the Vote's Privacy Policy and agree to receive occasional election reminder emails from Rock the Vote. In addition, you authorize and permit Producer to share your personal information, including, but not limited to, your contact information, with such affiliated entities, partners, licensors, exhibitors, vendors, contractors, and/or other third parties (i) with which you authorize in connection with the Event, including, but not limited to, scanning ticket(s) and/or pass(es) in connection with the Event, accessing such third party’s content in connection with the Event and/or utilizing any Digital Technologies (as defined herein); and/or (ii) which may offer products, services, and/or goods that may be of interest to you. By registering for the Event, you thereby authorize and permit Producer and third parties to share your personal information, including, but not limited to, your contact information, with such entities, exhibitors, vendors, contractors, or third parties associated with such registration and/or the Event.
“Digital Technologies” are defined as the Event website and/or its other digital and/or social media platforms, any distribution or technology platforms for any digital aspects to the Event; any on-site or web-enabled technologies, including, but not limited to, on-site Wi-Fi, on-site interactive kiosks, wearable beacon technology and/or RFID technology; and any mobile applications associated with the Event. The Event’s Digital Technologies are neither directed at nor intended for use by Minors under the age of eighteen (18). Producer does not knowingly collect personal information from individuals under the age of eighteen (18), and if Producer becomes aware that it has inadvertently done so, Producer will promptly delete such personal information. All Minors Attending are hereby instructed not to access, or participate in any way, with Digital Technologies unless done so with the express consent of these Terms and Conditions by their parent or legal guardian. Further, Minors Attending under the age of eighteen (18) should only participate in the Digital Technologies under the direct supervision of their parent or legal guardian, if such participation is permitted by Producer in Producer’s sole discretion.
SECURITY
Producer reserves the right to modify, suspend, extend or terminate the Event, or any part thereof, or any person(s) Attending thereto, if Producer determines, in its sole and absolute discretion, that the Event or any part thereof has been, or is suspected to be, tampered with or disrupted due to causes beyond Producer’s control in a manner which may undermine or corrupt the security, integrity or feasibility of the Event or any portion thereof as contemplated herein. Although Producer shall endeavor to ensure the security and integrity of the Event, in the event the Event or any part thereof is terminated or has any change in date, time, or location, for any reason beyond Producer’s control, Producer shall not be liable to you in any way and Producer shall have no further financial obligations to you.
Additionally, Producer is not responsible for the actions of any other persons Attending the Event or otherwise in connection with the Event, including, but not limited to, any person(s) attempting to circumvent or otherwise interfere with the security, integrity, or proper conduct of the Event. Your interactions with third parties, including, but not limited to, guests and other person(s) in connection with the Event, are solely between you and such third party(ies). You acknowledge and agree that the Released Parties will not be responsible for any damages, losses, costs, expenses, or liabilities incurred as the result of such interactions with third parties. Producer is also not responsible for any problems or technical malfunction of any network or lines, servers or providers, equipment or software which are beyond Producer’s control, including, but not limited to, any injury or damage to you or your property resulting from Attending the Event.
LIMITATION OF LIABILITY
YOU AGREE THAT THE EVENT AND/OR ANY AND ALL EVENT RELATED ACTIVITIES, ATTRACTIONS, AND/OR RIDES, PRODUCTS AND/OR SERVICES PROVIDED OR SOLD AT OR IN CONNECTION WITH THE EVENT, INCLUDING, WITHOUT LIMITATION, ANY SECURITY MEASURES USED BY PRODUCER TO PROTECT THE EVENT, ARE PROVIDED STRICTLY ON AN “AS-IS” BASIS. IN CONNECTION WITH THE EVENT, PRODUCER SPECIFICALLY AND EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS, WARRANTIES, GUARANTEES, CONDITIONS, ASSURANCES OR OTHER TERMS, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ANY WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE WITH RESPECT TO THE EVENT, AND ANY REPRESENTATIONS THAT THE EVENT, RIDES, ATTRACTIONS, AND/ OR THE SECURITY MEASURES FOR AND/OR IN CONNECTION WITH THE EVENT WILL BE FREE FROM DEFECTS, OPERATE OR BE FULFILLED WITHOUT ISSUE OR DELAYS, OR THAT THERE WILL BE NO CIRCUMVENTION OF THE EVENT OR ITS SECURITY MEASURES.
IF ANY APPLICABLE AUTHORITY HOLDS ANY PORTION OF THIS SECTION TO BE UNENFORCEABLE, THEN THE RELEASED PARTIES’ LIABILITY WILL BE LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY APPLICABLE LAW. WITHOUT LIMITING THE FOREGOING, UNDER NO CIRCUMSTANCES SHALL THE RELEASED PARTIES BE LIABLE FOR ANY CLAIM, LOSS, COST, EXPENSE, OR DAMAGE WHATSOEVER TO YOU IN AN AMOUNT EXCEEDING THE SUM OF THE FEES ACTUALLY PAID TO ATTEND THE EVENT.
IN NO EVENT WILL PRODUCER, THE RELEASED PARTIES, THEIR RESPECTIVE, SUPPLIERS, ADVERTISERS, AND SPONSORS, BE RESPONSIBLE OR LIABLE TO YOU OR ANYONE ELSE FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY TYPE, AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, ARISING OUT OF OR IN CONNECTION WITH THE EVENT, ACTIVITIES AT THE EVENT, THE EVENT’S WEBSITE AND/OR ITS OTHER DIGITAL AND/OR SOCIAL MEDIA PLATFORMS, ANY PRODUCT OR SERVICE PURCHASED AT OR IN CONNECTION WITH THE EVENT, EVEN IF PRODUCER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER THE CLAIM IS BASED UPON ANY CONTRACT, TORT, OR OTHER LEGAL OR EQUITABLE THEORY.
ACKNOWLEDGMENT OF TERMS AND CONDITIONS
By Attending the Event, You acknowledge and agree that you have read, and agree to comply with, the Terms and Conditions stated herein and agree that these terms shall be construed by and governed in accordance with the laws of the State of California.
MANDATORY ARBITRATION AGREEMENT AND CLASS ACTION WAIVER
YOU AND PRODUCER EACH AGREE THAT ANY DISPUTE OR CLAIM RELATING IN ANY WAY TO THE TERMS AND CONDITIONS, YOUR USE OF THE EVENT SITE, EVENT WEBSITE OR OTHER EVENT RELATED DIGITAL AND/OR SOCIAL MEDIA PLATFORMS, YOUR TICKET, PRODUCTS AND/OR SERVICES SOLD, DISTRIBUTED, ISSUED, OR SERVICED BY OR THROUGH PRODUCER, AND/OR YOUR ATTENDING OF THE EVENT WILL BE RESOLVED SOLELY BY BINDING ARBITRATION.
YOU ACKNOWLEDGE THAT YOU AND PRODUCER ARE EACH WAIVING THE RIGHT TO FILE A LAWSUIT AND THE RIGHT TO A JURY TRIAL. YOU AND PRODUCER ALSO AGREE THAT ANY AND ALL DISPUTES MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITIES. YOU AND PRODUCER THEREFORE AGREE TO WAIVE ANY RIGHT TO LITIGATE OR ARBITRATE ANY CLAIMS AS A CLASS ACTION OR OTHER REPRESENTATIVE OR COLLECTIVE ACTION.
Exceptions. The arbitration agreement and class action waiver set forth hereinabove are subject to these limited exceptions:
You may assert claims in small claims court if your claims apply.
If a claim involves the conditional license granted to you as described in the Ownership section above, either you or Producer may file a lawsuit in a federal or state court located within Los Angeles County, California, and both you and Producer consent to the jurisdiction of those courts for such purposes.
In the event that the arbitration agreement in the Terms and Conditions is for any reason held to be unenforceable, any litigation against Producer (except for small claims court actions) may be commenced only in a federal or state court located within Los Angeles County, California, and you and Producer each consent to the jurisdiction of those courts for such purposes.
You and Producer each retain the right to participate in class-wide settlement of claims.
Informal Dispute Resolution. You and Producer each recognize and agree that good faith, informal efforts to resolve disputes often result in prompt, low-cost, and mutually beneficial outcomes. Therefore, you and Producer each agree that, before either of us may commence an arbitration or assert a claim in small claims court, you and Producer will engage in the following informal dispute resolution process:
The party seeking to initiate a claim in arbitration or small claims court (“claimant”) must give written notice to the other party (“respondent”). To notify Producer that you intend to initiate informal dispute resolution, you must send an email to Producer at info [at] taskforce [dot] us providing: your full name; the email address you used to register to Attend the Event; your counsel’s name and contact information, if you are represented by counsel; and a brief description of your claim(s) and the relief sought. To notify you that we intend to initiate informal dispute resolution, we will email you at the email address you provided at registration and provide a brief description of our claim(s) and the relief sought, and our counsel’s name and contact information.
You and Producer will then personally meet and confer, via teleconference or videoconference, in a good faith effort to informally resolve any claim covered by this mutual arbitration agreement. If either you or us is represented by counsel, that counsel may participate in the informal dispute resolution conference.
All offers, promises, conduct, and statements made in the course of the informal dispute resolution process by any party, its agents, employees, and attorneys are confidential and not admissible for any purpose in any subsequent proceeding, provided that evidence that is otherwise admissible or discoverable shall not be rendered inadmissible or non-discoverable as a result of its use in the informal dispute resolution process.
The informal dispute resolution conference shall occur within sixty (60) days of receipt of the written notice described above, unless an extension is mutually agreed upon by you and Producer. If, after participating in that conference, you and we have been unable to resolve the dispute, the claimant may commence an arbitration or assert a claim in small claims court in accordance with this arbitration agreement.
Any statute of limitations will be tolled while you and we engage in the informal dispute resolution process described in this section.
This agreement to binding arbitration evidences a transaction in interstate commerce, and thus the Federal Arbitration Act (9 U.S.C. § 1 et seq.) (“FAA"), governs, among other things, the interpretation and enforcement of this arbitration agreement and all of its provisions, including, without limitation, the class action waiver. This agreement to binding arbitration will survive its termination. If any portion of this agreement to binding arbitration is deemed invalid or unenforceable, the remaining portions shall nevertheless remain in force.
AUTHORITY
Producer shall have sole authority over all aspects of the planning, promotion, production and operation of the Event, including without limitation, determining the location of the Event, the Event website and its other digital and/or social platforms, and the scheduling, rescheduling, and if, when and for how long the Event will occur.
RESERVATION OF RIGHTS; NO WAIVER
Producer reserves all rights not expressly disclaimed in these Terms and Conditions. Producer reserves the right to take any action that is reasonably necessary in the sole judgment of Producer for the protection of the Event and/or the persons Attending the Event. Neither the failure of Producer to require strict compliance with any provision of these Terms and Conditions nor the failure, delay or omission by Producer in exercising any right with respect to any provision of these Terms and Conditions will be construed as a waiver or relinquishment to any extent of Producer’s right to assert or rely upon any such provision or right in that or any other instance.
SURVIVAL
Any provision of these Terms and Conditions which imposes an obligation on You after the Event concludes shall be deemed to survive the conclusion of the Event.
SEVERABILITY
If any provision of these Terms and Conditions is judged to be invalid or unenforceable, the defective provision shall first be revised, limited or amended, consistent with the general intent of the provision, such that it is valid and enforceable, and the remaining provisions of these Terms and Conditions shall be unaffected and shall remain enforceable.
HEADINGS
The section headings in these Terms and Conditions are for reference purposes only and shall not in any way affect the meaning or interpretations of these Terms and Conditions.
INTEGRATION; NON-RELIANCE; REMEDIES CUMULATIVE
These Terms and Conditions, including the terms incorporated by reference herein, constitute a legal, valid, and binding obligation, enforceable in accordance with its terms. You acknowledge that in agreeing to these Terms and Conditions you have not relied on, and shall have no right or remedy in respect of, any statement, representation, assurance or warranty (whether made negligently or innocently) other than as expressly set out in these Terms and Conditions. The rights and remedies provided by these Terms and Conditions are cumulative and use of any one right or remedy by either You or Producer shall not preclude or waive the right to use any or all other rights or remedies. Such rights and remedies are given in addition to any other rights or remedies You and Producer may have by law, statute, ordinance, or otherwise.
HEALTH & SAFETY ACKNOWLEDGEMENT
Please make sure that you have reviewed any advisories or restrictions that may be in place for travel to the United States and for travel to the location of the Event. Visit https://covid19.ca.gov/ for information.
Please be advised that a risk of exposure to COVID-19 exists in any event or public space, including the Event. Prior to registering for and attending the Event, please ensure you have read the latest CDC Guidelines for Prevention. By attending the Event, you acknowledge this inherent risk and, as a condition of entering the Event, you acknowledge, understand and confirm each of the following in accordance with applicable health guidelines:
that you will abide by all Event health-and-safety requirements;
that you are not currently experiencing any of the following symptoms of COVID-19, as identified at CDC.gov, including, but not limited to:
Fever or chills
Cough
Shortness of breath or difficulty breathing
Fatigue
Muscle or body aches
Headache
New loss of taste or smell
Sore throat
Congestion or runny nose
Nausea or vomiting
Diarrhea
that prior to attending the Event you have not been in contact with someone with confirmed or suspected COVID-19 symptoms without completing a quarantine as dictated by the most current guidelines; and
that you are not under any self-quarantine orders.
Please do not enter the Event if you cannot confirm all of the above criteria. If at any point during your time at the Event you do not meet all of the above criteria, you and those in your group (which may include your exhibiting company) will be required to isolate and may be relocated or asked to leave the Event at Producer's sole discretion.
